The Texas Supreme Court's 34th Emergency Order which applied to the provisions of the moratorium to Texas Courts, has expired, effective March 31,2021. Even though the Texas Supreme Court’s Order has expired, the moratorium itself has been extended by the CDC until June 30, 2021. Evicting a tenant in violation of the moratorium can result in civil or criminal penalties for the landlord. So it is now up to the landlord to decide if they wish to go forward with the case, to dismiss the case entirely, or to wait until the moratorium expires to go forward with the case.  The Supreme Court has issued its 35th Emergency Order that implements the Texas Eviction Diversion Program to curb the possible surge of evictions due to the COVID-19 pandemic, assist Texas’s most vulnerable tenants, and provide landlords with an alternative to eviction. This program is in effect from February 15,2021 through May 12,2021 unless extended by the Chief Justice of the Supreme Court.
