The Probate Department deals with the following:
- Probate of Wills
- Letters Testamentary
- Letters of Administration
- Muniment of Title
- Small Estate Affidavit (Form)
When a person passes away and may or may not have left a Will, an application for:
"Probate of Will/ Letters Testamentary of Letters of Administration" is filed in order to disburse the estate. An "Order Admitting" on of the applications must be signed by the court approving the application.
"Guardianships" are filed when a minor or a person who is either physically or mentally unable to care for themselves needs assistance with their everyday affairs. An application is filed and an order must be signed by the court approving the application and appointing a guardian.
A "Small Estate" can be filed when the estate is valued at less than $50,000 and there is no real-estate involved.
Again, an order is signed by the court approving the application.
